1. Agreement

These Terms of Service (the "Terms") are a binding agreement between you and Jason Pieter Kusumajaya, an individual sole trader of Jl Taman Ubud Asri I No. 15, Tangerang, Banten 15810, Indonesia, trading as PrivBoard ("we", "us"). They govern the PrivBoard keyboard app for Android and, once released, iOS, and the website at https://privboard.360framed.com (the "Service"). By installing or using the Service you accept these Terms and our Privacy Policy, which is part of them. If you do not accept them, do not use the Service.

2. Eligibility

You must be at least 13 years old, or the higher minimum age of digital consent in your country, to use the Service. You must also be old enough to enter a binding contract where you live, or have a parent or guardian agree to these Terms for you. Subscriptions are bought through an Apple or Google account, which has its own age rules. You may not use the Service where the law prohibits it, or if you are in a country or territory under comprehensive trade sanctions.

3. The Service

PrivBoard is a keyboard. When mixing is on, it translates each word you finish into a random language from a list you choose before the word reaches the app you are typing in. You see your own words in a preview bar.

  • It hides your text from people and apps that read the text field. It is not encryption and it is not a security guarantee. Anyone who understands the languages involved can read the result.
  • Automatic translation of single words is imperfect and may be wrong, odd or unreadable. Check anything that matters before you send it.
  • Do not rely on mixing for emergency, medical, legal, safety or other messages that must be understood. Turn it off with the MIX key.
  • Some apps and fields behave differently, and the keyboard does not mix passwords, email addresses, web addresses, numbers or phone numbers.

4. Subscription, free trial and billing

  • PrivBoard needs a subscription: $2.99 per month or $29.99 per year, plus any taxes. The price shown by the store at checkout is the binding price and may be shown in your local currency.
  • Each plan starts with a 3-day free trial. The store shows the day the first charge will happen before you confirm.
  • STORE SUBSCRIPTIONS RENEW AUTOMATICALLY at the end of each period, for a period of the same length and at the then-current price, unless you cancel at least 24 hours before the period ends. Your store account is charged for renewal within the 24 hours before the period ends. If you do not cancel during the trial, it converts into a paid subscription.
  • You buy through Google Play or the Apple App Store, and that store is the seller. Manage or cancel in your store account. Google Play: Payments and subscriptions, then Subscriptions (https://play.google.com/store/account/subscriptions). Apple: Settings, your name, Subscriptions (https://apps.apple.com/account/subscriptions). Deleting the app does not cancel a subscription.
  • If a renewal payment fails, the store may retry it for a grace or hold period. If payment is not received, the keyboard locks until you subscribe again. Your settings stay on your phone.
  • We may change prices or plans with at least 30 days' notice. A change applies from your next renewal after the notice period. Where the store needs your consent to a price increase, the subscription ends if you do not give it.

5. Refunds and withdrawal rights

Because the store is the seller of record, refund requests must go to the store you bought from, under its refund policy. If you are a consumer in the EU, the EEA or the United Kingdom, you have a legal right to withdraw from a digital service contract within 14 days, and the store may ask you at checkout to agree that the service starts immediately. Nothing in these Terms removes a refund, cancellation or withdrawal right you have under the consumer law of your country. If a store refuses a refund you think you are owed by law, write to support@privboard.360framed.com and we will review it.

6. Licence and intellectual property

The Service, including the software, design, logo and name, is owned by or licensed to us and protected by intellectual property law. While you comply with these Terms and have an active subscription or trial, we give you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control. You may not copy, modify, reverse engineer or resell the Service, except where the law allows it despite this clause. Third-party components remain under their own licences. If you send us feedback, we may use it freely.

7. Your content

You keep all rights in what you type and in any photo you choose as a background. We do not receive them, and we need no licence to them. You are responsible for what you write with the keyboard and for following the law and the rules of the apps you use.

8. Acceptable use

You must not use the Service for anything unlawful, to harass, defraud or deceive other people, or to evade a legal duty to keep readable records. You must not probe, attack or circumvent the security of the Service, including its subscription check, or use it to send malware. We may suspend access where we reasonably believe you have breached this section.

9. Third-party services

The Service relies on third parties, including Apple, Google, RevenueCat and our host. Their handling of personal data is described in the Privacy Policy. Your use of a store is also governed by that store's terms. We are not responsible for services we do not control.

10. Availability and changes

We try to keep the Service available but do not promise it will be uninterrupted or error free. We may change, add or remove features. If a change materially reduces what a paid plan offers, we will tell you in advance and you may cancel.

11. Disclaimer of warranties

TO THE FULLEST EXTENT THE LAW ALLOWS, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF TRANSLATION AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT MIXING WILL KEEP ANY TEXT PRIVATE.

12. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA OR GOODWILL, INCLUDING LOSS CAUSED BY A MESSAGE BEING MISUNDERSTOOD BECAUSE OF TRANSLATION. OUR TOTAL LIABILITY FOR ALL CLAIMS IN ANY TWELVE-MONTH PERIOD IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID FOR THE SERVICE IN THAT PERIOD AND USD 50. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, gross negligence, wilful misconduct, or anything else that cannot be limited by law. Your rights as a consumer under mandatory law are not affected.

13. Indemnity

To the extent the law allows, you will indemnify us against claims, losses and reasonable costs arising from your breach of these Terms or your unlawful use of the Service. This does not apply to consumers where such a clause is not enforceable.

14. Suspension and termination

You may stop using the Service at any time by cancelling your subscription and uninstalling the app. We may suspend or end your access immediately for a material breach, fraud, unlawful use or a threat to security, and otherwise with 30 days' notice. Sections that by their nature should survive termination do so.

15. Additional terms for Apple users

This section applies once the iOS app is released. These Terms are between you and us, not Apple Inc. ("Apple"). We, not Apple, are responsible for the app, for maintenance and support, and for any claim about it. Your licence is limited to Apple devices you own or control, under Apple's Usage Rules. If the app fails to conform to a warranty, you may tell Apple, which may refund the purchase price. Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm you are not in a country under a US embargo or on a US prohibited-party list.

16. Governing law and disputes

These Terms are governed by the law of Indonesia. Disputes are brought before the courts of Indonesia, unless mandatory consumer law gives you the right to bring a claim in the courts of the country where you live. Please write to us first at support@privboard.360framed.com and we will try to settle it.

17. Changes to these Terms

We may amend these Terms. We will give at least 30 days' notice of a material change in the app or on our website. If you do not accept an amendment, cancel your subscription and stop using the Service before it takes effect.
